Terms of Services

I provide several services including branding, corporate identity, graphics design, web design, application development, database design, and website maintenance. Below is a list of all my service contracts and maintenance contract plans in which I offer and follow. Any of these terms may change at any given time without notice so please check back often.

General Terms and Conditions

All service contract below follows the general relationship of the client and the service provider.

The relationship of client, and service provider is NOT an employee to a company, but IS a client to a freelance/independent contractor, or company. The work is to be carried out by the service provider at any time as long as the deadline is met through the use of any methods in which is best.

The client, and the service provider is liable ONLY for their own lost profit, or damages of any kind and are NOT entitled or liable for each others.

All services are subject to end at any given time and a notification will be sent to each client signed under a contract.

Service Terms and Conditions

This terms of agreement is between the client, and the service provider, Vu Tran for a specific service or project that is to conducted for the client, by the service provider.

The service offered and provided by the service provider, Vu Tran, is charged accordingly with a set of guidelines, requirements, timeline, and requests given by the client to the service provider.

Once a project has been completed, and meets all of the specifications provided by the client in the beginning of the term, any further changes and additions will be subjected for charges accordingly.

Any feature, or function that WAS NOT mentioned in the original contract by the client will be considered as an additional change and will be charged separately. Assuming that a feature, or function will be included does not mean that it is part of the terms. Only those feature and functions mentioned in the beginning of the term by the client is included in the quoted price.

The client is to pay 50% of the total project cost as a down payment and the final 50% of the total project cost upon completion of the project.

Website Maintenance Terms and Conditions

"Website Maintenance" will be between the client, and the service provider.

The service described as "website maintenance" includes revising, editing, or otherwise changing existing web pages to keep the website up to date. Additional pages are also included in this service.

What is NOT included in this contract is design and development. Design is referred to the process of creating a new look, brand, or identity from scratch. Development is referred to the process of developing a new feature, script, section, area, or page that are not already present on the current website.

If at some point, another designer or developer has worked on the website that this agreement entitles to and breaks a current feature or function on the existing website, there will be additional charges that will be incurred for time spent on repairs.

The service provider will take all requests into consideration and determine whether or not each request meets the requirement to fit in this contract. If the request is NOT provided under this service contract, a new agreement or contract will be written solely for that project.

The billing cycle will last for a specified length of time (in months) agreed between the client, and the service provider. The billing cycle will be made on the first of each month for that month. In the case of a contract termination, the contract will expire at the end of the billed month of request. There will be no payments to be made for the upcoming month preceding the month of termination. Upon term expiration, a new contract will be sent to the client for continued services.

Recurring fees may increase at any given time, and the client will be given a notice a month prior to the beginning of the term renewal date.
